Terms of Service

Last updated: October 13, 2026. The changes of October 11 take effect October 14, 2026. The changes to letters and time capsule posts (Sections 5.1, 5.3 and 8) and to copies of a timeline and what happens if FM2Y closes (Section 11) take effect October 13, 2026.

These Terms of Service (“Terms”) govern your use of FM2Y, a private family memory platform operated by Trimble Digital LLC (“FM2Y,” “we,” “our,” or “us”). By creating an account or using FM2Y, you agree to these Terms. If you do not agree, do not use FM2Y.

1. The service

FM2Y provides private digital timelines for preserving family memories, including photos, videos, voice notes, written letters, and milestone records. Timelines are private by default. Access is controlled entirely by the timeline owner.

Every timeline starts on the Free plan. Plans are set per timeline, and a timeline’s features and storage limits depend on its plan.

2. Eligibility

You must be at least 18 years old to create an FM2Y account. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

Signup is open. Once you confirm your email address, you can start a Free timeline. There is no waitlist. We may limit or suspend access as described in Section 14.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hi@shmo.me if you believe your account has been compromised.

You may not share your account with others or allow others to access FM2Y through your credentials. Each person who wishes to use FM2Y should create their own account.

4. Timeline ownership and roles

4.1 Timeline owner

The person who creates a timeline is the timeline owner. The owner has full control over the timeline: they can invite contributors, set permissions, configure billing, access all settings, delete posts, enable moderation, and designate custodians and beneficiaries.

Only the timeline owner can initiate a handoff or transfer. Only the timeline owner can designate a beneficiary (the person who will receive the timeline).

If the owner deletes their FM2Y account on the web or by email, they choose for each timeline they own: hand it to one of its co-admins, who then owns it whole, or delete it. A timeline with no co-admin is deleted, and deleting the account from the current version of the app deletes every timeline the owner owns. Deleting a timeline permanently removes all of its content, including content contributors added.

4.2 Contributors

Contributors are people invited by the timeline owner to add content to a timeline. Contributors are granted specific permissions by the owner (view, post, upload, approve, or manage). Permissions are set per-contributor and can be modified or revoked by the owner at any time.

Contributors who add content to a timeline grant FM2Y and the timeline owner a perpetual, irrevocable, royalty-free license to store, display, and deliver that content as part of the timeline, including to the eventual beneficiary. Contributors do not retain ownership of content after it is added to a timeline, and cannot demand its removal, except that a contributor who deletes their FM2Y account on the web or by email chooses whether their posts, notes and reactions on other people’s timelines are deleted with it or stay on those timelines, shown as from “Deleted member” (see Section 14). Deleting the account from the current version of the app keeps them.

Contributors on timelines in a grace period or suspended state are read-only. They can view the timeline but cannot add new content until the timeline is active again.

4.3 Co-admins

A timeline owner may designate co-admins who have nearly full administrative access. Co-admins cannot transfer ownership, modify billing, or revoke the owner’s own access. Co-admin status does not create any ownership claim over the timeline.

4.4 Custodians

A custodian is a designated person who will receive ownership of a timeline under specified conditions (age-based transfer when the subject reaches a specified age, inactivity-based transfer if the owner becomes inactive beyond a defined period, or explicit manual transfer). Custodian designation is not a binding legal assignment of any rights; it is an instruction to FM2Y’s automated systems about how to handle the timeline.

4.5 Beneficiaries

A beneficiary is the person for whom the timeline is ultimately intended, typically the child the timeline is about, upon reaching adulthood. Designating a beneficiary allows FM2Y’s system to notify and transfer ownership when the subject turns 18 (or at a custom age set by the owner). Beneficiary designation creates no legal rights in the beneficiary until a transfer is completed.

5. Plans and billing

5.1 Free plan

Confirming your email address gives you a Free timeline. Every account may own one Free timeline, with 5 GB of storage, room for the owner and three invited people, five sealed letters, and five time capsule posts waiting to open. Every account may also seal one free time capsule, once, with the same 5 GB of storage and room for the owner and three invited people. It does not count as the account's Free timeline. The Free plan requires no payment information.

5.2 Paid options

FM2Y does not sell paid plans, add-ons or Love Tokens today. If we offer them in the future, we will show the price and what it includes before you buy, and we will update these Terms first. A paid plan, gift or Love Tokens bought before these Terms took effect stay in effect, and Sections 5.3 to 5.5 apply to them.

5.3 Lapsed funding and the grace period

If a paid timeline’s funding lapses, it enters a grace period of three (3) years from the lapse date. During the grace period the timeline is in download-only mode: existing memories remain stored, the owner may export all content at any time, and no new content can be added. The owner may re-activate the timeline at any point during the grace period by restoring funding, which resumes full access with nothing lost. After the grace period ends, FM2Y may permanently delete the timeline’s stored content, following at least 30 days’ notice to the owner’s registered email address.

Time capsule posts that were posted before a lapse will still open on their date for as long as the timeline’s content remains stored.

5.4 Refunds

Payments to FM2Y are non-refundable except where a refund is required by applicable law or granted at our discretion. This includes subscription payments, one-time plan payments, Love Token purchases, storage add-ons, and gifts. Canceling a subscription stops future charges but does not entitle you to a refund of any amount already paid. Purchases made through the Apple App Store or Google Play are also subject to that store’s refund policies. If you believe there has been a billing error, contact us at hi@shmo.me and we will investigate.

5.5 Love Tokens

Love Tokens are prepaid credits that buy time on FM2Y timelines. Tokens sit in your account wallet and are spent by allocating them to a specific timeline, where they convert into paid time at that timeline’s plan rate. Timelines always display funded time, never token or dollar balances.

Love Tokens never expire. They have no cash value, are not redeemable or exchangeable for cash, and are not transferable between people, accounts, or wallets. Tokens may be redeemed only for FM2Y services. Once allocated to a timeline, tokens become committed funding for that timeline and cannot be returned to a wallet. Bonus tokens are promotional credits and carry the same terms. A monthly token subscription renews automatically until cancelled; you may cancel at any time and keep all tokens already credited.

If you delete your account, tokens left in your wallet are forfeited. Funded time left on a timeline that is deleted with your account is also forfeited, including time other people funded. Nothing is refunded. Funded time on a timeline you hand to a co-admin stays with that timeline.

6. Content and conduct

6.1 Your content

You retain ownership of content you create and upload to FM2Y. By uploading content, you grant FM2Y a limited, non-exclusive, royalty-free license to store, process, transmit, and display your content as necessary to operate the service (including applying watermarks on timelines with Shield enabled, generating previews, and delivering content to authorized viewers). This license ends when you delete the content or close your account.

6.2 Prohibited content

You may not upload or share content that:

  • Is illegal under any applicable law, including child sexual abuse material (CSAM). We have zero tolerance for CSAM and will report it to law enforcement and NCMEC immediately.
  • Constitutes harassment, threats, or targeted abuse of any person.
  • Infringes the intellectual property rights of others.
  • Contains malware, viruses, or malicious code.
  • Is designed to circumvent FM2Y’s security or access controls.

6.3 Post moderation

Any timeline may enable Post Moderation. When moderation is on, posts from contributors (not the owner or co-admins) are held for approval before appearing on the timeline. During a grace period or suspension, no new posts enter the moderation queue. Existing pending posts remain in the queue and can be approved or rejected when the timeline is restored to active status.

6.4 Our right to remove content

We reserve the right to remove content that violates these Terms, that is reported as harmful or illegal, or that we are legally required to remove. We will notify you if we remove content except where legally prohibited from doing so.

7. Privacy Memory Shield

Timelines on any paid plan may enable Private Memory Shield. When Shield is enabled, all photos served through the platform carry a server-side watermark with the viewer’s name and timestamp. This watermark is applied before the image reaches the user’s device. By enabling Shield, the timeline owner consents to this processing on behalf of all viewers of that timeline. Contributors who access a Shield-enabled timeline consent to their images being watermarked by the act of accessing the content.

8. Letters and time capsule posts

A sealed letter is a post its writer addresses to the person the timeline is for, and to any other members the writer adds. The other members it is addressed to can open it as soon as it is posted, and the person the timeline is for can open it once the timeline is theirs. Members it is not addressed to see only its envelope, and members it is hidden from (an invisible letter) do not see it at all. The writer can always open their own letter. The timeline’s admins (its owner, co-admins and billing owner) can also open letters written by members who are not admins, but not a letter written by another admin. A letter posted in a time capsule that has not opened yet stays closed for everyone, its writer and the people it is addressed to included, until the time capsule opens. The writer may edit or delete their letter at any time, except while it is in a time capsule that has not opened. Who it is to, and whether it is sealed or invisible, are set when it is sent.

A time capsule post is a post that opens on a date its writer picks, for everyone on the timeline, or for the members the writer chooses plus its writer and the timeline’s admins. Before that date no one can open it, including its writer and the person the timeline is for, except that the timeline’s admins can open one written by a member who is not an admin, and that opens it only for that admin. A time capsule post written by an admin stays closed for everyone, other admins included, until its date. Before its date, its writer may delete it but cannot open or edit it, and the timeline’s admins may delete one written by a member who is not an admin. When a member’s posts need an admin’s approval, their time capsule posts do too. On its date our server opens it automatically, and the person the timeline is for can open each one whose date has passed once the timeline is theirs. A post is either a letter or a time capsule post, not both.

FM2Y opens a letter or a time capsule post only when required by law or legal process, to act on a safety report with the approval of counsel, or as Section 11 describes, when it makes a copy of a timeline or if FM2Y closes. Every copy has every letter and time capsule post open and readable.

FM2Y is not responsible for technical failures that delay the opening of time capsule posts, though we make commercially reasonable efforts to open them on time. Time capsule posts that were posted before a billing lapse will still open on their date for as long as the timeline’s content remains stored (see Section 5.3).

If a time capsule’s owner deletes their account without handing the capsule to a co-admin, the capsule and every letter sealed in it are deleted and are never delivered. If a person who sealed a letter in someone else’s capsule deletes their account and chooses to delete their posts, their sealed letters are deleted too.

9. Timeline handoffs and custodial transfers

FM2Y provides automated tools for transferring timeline ownership. We are not a fiduciary, trustee, or legal executor. Custodian designations and beneficiary assignments within FM2Y are instructions to our software systems and do not constitute legally binding trust instruments, wills, or power of attorney documents.

For matters of legal succession, estate planning, or the formal transfer of digital assets, you should consult a licensed attorney.

10. Intellectual property

FM2Y, its logo, design, code, and non-user-generated content are the property of Trimble Digital LLC, protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without written permission.

11. Disclaimers

FM2Y is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that data will never be lost.

We strongly recommend that you maintain personal backups of content you consider irreplaceable. While a timeline is in download-only mode, its owner can export a full copy from the timeline’s settings. At any other time, the owner can ask us for a copy at hi@shmo.me. Either copy is an HTML version of the timeline that opens in any web browser, with every photo, video and voice note as it was uploaded. A copy has no logins or permissions, so everything in it is open and readable: every sealed and invisible letter, and every time capsule post, including one that hasn’t reached its date. Anyone who has the copy can read all of it.

If FM2Y ever closes, we will email every account holder at least 30 days before the service ends. On the first of those 30 days, every letter and every time capsule post opens for the timeline’s owner and for the people it is for. For those 30 days every timeline stays open to view and download: no one can post, and each timeline’s owner can download a full copy, the same HTML version, with every photo, video and voice note at the quality it was uploaded.

12. Limitation of liability

To the maximum extent permitted by applicable law, FM2Y and its affiliates, officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, service interruption, or any other intangible losses, arising from:

  • Your use of or inability to use FM2Y;
  • Unauthorized access to or alteration of your data;
  • The conduct of any third party on or through FM2Y;
  • Any bugs, viruses, or other harmful code transmitted through FM2Y;
  • Errors or omissions in any content, or any loss or damage resulting from use of content.

In no event shall our total aggregate liability to you for any claim exceed the greater of (a) the amount you paid FM2Y in the 12 months before the claim, or (b) $100 USD.

13. Indemnification

You agree to indemnify, defend, and hold harmless FM2Y and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of FM2Y, your violation of these Terms, your violation of any third party’s rights, or any content you upload to FM2Y.

14. Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if required by law. You may delete your account at any time in the app (Profile, then Delete account), at fm2y.com/delete-account, or by contacting us at hi@shmo.me. That page describes what deletion removes, keeps and forfeits (see also Sections 4.1, 4.2, 5.5 and 8). Deletion cannot be undone, and no payment is refunded because of it. Subscriptions bought through the Apple App Store or Google Play must be cancelled there.

Upon termination, your right to use FM2Y ceases immediately. Sections 4.2 (contributor license), 6.1 (content license), 10 (IP), 11 (disclaimers), 12 (liability), 13 (indemnification), and 15 (governing law) survive termination.

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of FM2Y shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.

If you are a consumer in a jurisdiction with mandatory local consumer protection laws, those laws may give you rights that override this clause.

16. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before the change takes effect. Continued use of FM2Y after the effective date of updated Terms constitutes acceptance of those Terms.
