Terms of Service

These Terms of Service ("Terms") govern your use of FM2Y, a private family memory platform operated by Trimble Digital LLC ("FM2Y," "we," "our," or "us"). By creating an account or using FM2Y, you agree to these Terms. If you do not agree, do not use FM2Y.

1. The service

FM2Y provides private digital timelines for preserving family memories, including photos, videos, voice notes, written letters, and milestone records. Timelines are private by default. Access is controlled entirely by the timeline owner.

FM2Y is a subscription service. Timelines operate on a per-timeline billing model. Features and storage limits depend on the plan associated with each timeline.

2. Eligibility

You must be at least 18 years old to create an FM2Y account. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

FM2Y is currently available by invitation or waitlist approval only, except for Fund It Fully purchasers who receive immediate access. We reserve the right to limit access during our early access period.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hi@shmo.me if you believe your account has been compromised.

You may not share your account with others or allow others to access FM2Y through your credentials. Each person who wishes to use FM2Y should create their own account.

4. Timeline ownership and roles

4.1 Timeline owner

The person who creates a timeline is the timeline owner. The owner has full control over the timeline: they can invite contributors, set permissions, configure billing, access all settings, delete posts, enable moderation, and designate custodians and beneficiaries.

Only the timeline owner can initiate a handoff or transfer. Only the timeline owner can designate a beneficiary (the person who will receive the timeline).

4.2 Contributors

Contributors are people invited by the timeline owner to add content to a timeline. Contributors are granted specific permissions by the owner (view, post, upload, approve, or manage). Permissions are set per-contributor and can be modified or revoked by the owner at any time.

Contributors who add content to a timeline grant FM2Y and the timeline owner a perpetual, irrevocable, royalty-free license to store, display, and deliver that content as part of the timeline, including to the eventual beneficiary. Contributors do not retain ownership of content after it is added to a timeline, and cannot demand its removal except by requesting account deletion from the timeline owner or from FM2Y.

Contributors on timelines in a grace period or suspended state are read-only. They can view the timeline but cannot add new content until the owner renews the subscription.

4.3 Co-admins

A timeline owner may designate co-admins who have nearly full administrative access. Co-admins cannot transfer ownership, modify billing, or revoke the owner's own access. Co-admin status does not create any ownership claim over the timeline.

4.4 Custodians

A custodian is a designated person who will receive ownership of a timeline under specified conditions (age-based transfer when the subject reaches a specified age, inactivity-based transfer if the owner becomes inactive beyond a defined period, or explicit manual transfer). Custodian designation is not a binding legal assignment of any rights; it is an instruction to FM2Y's automated systems about how to handle the timeline.

4.5 Beneficiaries

A beneficiary is the person for whom the timeline is ultimately intended — typically the child the timeline is about, upon reaching adulthood. Designating a beneficiary allows FM2Y's system to notify and transfer ownership when the subject turns 18 (or at a custom age set by the owner). Beneficiary designation creates no legal rights in the beneficiary until a transfer is completed.

5. Plans and billing

5.1 Free plan

Every account may create one free timeline with 5 GB of storage and up to 3 contributors. The free plan requires no payment information.

5.2 Subscription plans (Standard and Premium)

Paid subscription plans are billed per timeline, not per account. Each timeline has its own plan and billing schedule. Standard is $6/month or $50/year per timeline (25 GB, up to 10 contributors, Time Capsule, Private Memory Shield, View History, trash recovery). Premium is $12.99/month or $100/year per timeline (100 GB, unlimited contributors, everything in Standard).

Subscriptions renew automatically unless cancelled before the renewal date. You can cancel at any time from the Billing Portal accessible in your timeline settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.

5.3 Fund It Fully

Fund It Fully is a single one-time payment of $100 for every year remaining until the subject's 18th birthday (minimum $100). It funds the timeline through the subject's 18th birthday at full Premium plan access, with no renewals and no recurring charges.

At age 18, new contributions to a Fund It Fully timeline are locked. The owner may enable "Continue On" to allow continued posting through the download window. Years 18 to 21 are included as a download and sharing window for the beneficiary.

The first 100 Fund It Fully timelines earn a Founding Family badge displayed on their timeline for as long as the timeline exists. This badge cannot be transferred.

5.4 Storage add-ons

Additional storage can be purchased per-timeline on a monthly or annual subscription basis. If a storage add-on subscription lapses, new uploads above the base plan cap are paused. Existing files remain stored and are protected by the grace period described in Section 5.7. Renewing restores upload capability.

5.5 Gifting

Any person, not just contributors, may gift a month, a year, or Fund It Fully to a timeline on behalf of its owner. Gifts add paid time to a timeline's billing; they never convert to cash and do not grant the gifter any permissions, ownership, or rights over the timeline. Gifts are delivered through a claim link. If a gift goes unclaimed after its claim window, contact us at hi@shmo.me and we will re-issue or apply it. Gifts are non-refundable (see Section 5.8).

5.6 Grace period

When a timeline's paid_through_at date passes, the timeline enters a 14-day grace period. During the grace period, the timeline remains accessible in view-only mode. Contributors cannot add new content. We send daily email and push notifications to the owner during the grace period. After 14 days without renewal, the timeline moves to suspended (download-only) mode.

Sealed letters that were posted and sealed before a lapse are grandfathered and will deliver on their unlock date for as long as the timeline's content remains stored, including throughout the grace period described in Section 5.7.

5.7 Suspension and grace period

If a timeline's funding lapses, it enters a grace period of three (3) years from the lapse date. During the grace period the timeline is in download-only mode: existing memories remain stored, the owner may export all content at any time, and no new content can be added. The owner may re-activate the timeline at any point during the grace period by restoring funding, which resumes full access with nothing lost. After the grace period ends, FM2Y may permanently delete the timeline's stored content, following at least 30 days' notice to the owner's registered email address.

5.8 Refunds

Payments to FM2Y are non-refundable except where a refund is required by applicable law or granted at our discretion. This includes monthly and annual subscription payments, Fund It Fully payments, Love Token purchases, storage add-ons, and gifts. Canceling a subscription stops future charges but does not entitle you to a refund of any amount already paid. Purchases made through the Apple App Store or Google Play are also subject to that store's refund policies. If you believe there has been a billing error, contact us at hi@shmo.me and we will investigate.

5.9 Love Tokens

Love Tokens are prepaid credits that buy time on FM2Y timelines. Tokens are credited to your account wallet when purchased and are spent by allocating them to a specific timeline, where they convert into paid time at that timeline's plan rate. Timelines always display funded time, never token or dollar balances.

Love Tokens never expire. They have no cash value, are not redeemable or exchangeable for cash, and are not transferable between people, accounts, or wallets. Tokens may be redeemed only for FM2Y services. Once allocated to a timeline, tokens become committed funding for that timeline and cannot be returned to a wallet.

Tokens may be purchased one time or through an optional monthly token subscription, which renews automatically until cancelled. You may cancel at any time and keep all tokens already credited. Monthly token subscriptions may include bonus tokens; bonus tokens are promotional credits and carry the same no-cash-value, non-transferable terms. Funding another person's timeline with your tokens is a gift of service time to that timeline; it does not transfer tokens to any person and does not grant you any rights over that timeline.

6. Content and conduct

6.1 Your content

You retain ownership of content you create and upload to FM2Y. By uploading content, you grant FM2Y a limited, non-exclusive, royalty-free license to store, process, transmit, and display your content as necessary to operate the service (including applying watermarks on timelines with Shield enabled, generating previews, and delivering content to authorized viewers). This license ends when you delete the content or close your account.

6.2 Prohibited content

You may not upload or share content that:

  • Is illegal under any applicable law, including child sexual abuse material (CSAM). We have zero tolerance for CSAM and will report it to law enforcement and NCMEC immediately.
  • Constitutes harassment, threats, or targeted abuse of any person.
  • Infringes the intellectual property rights of others.
  • Contains malware, viruses, or malicious code.
  • Is designed to circumvent FM2Y's security or access controls.

6.3 Post moderation

Premium timelines may enable Post Moderation. When moderation is on, posts from contributors (not the owner or co-admins) are held for approval before appearing on the timeline. During a grace period or suspension, no new posts enter the moderation queue. Existing pending posts remain in the queue and can be approved or rejected when the timeline is restored to active status.

6.4 Our right to remove content

We reserve the right to remove content that violates these Terms, that is reported as harmful or illegal, or that we are legally required to remove. We will notify you if we remove content except where legally prohibited from doing so.

7. Privacy Memory Shield

Timelines on any paid plan may enable Private Memory Shield. When Shield is enabled, all photos served through the platform carry a server-side watermark with the viewer's name and timestamp. This watermark is applied before the image reaches the user's device. By enabling Shield, the timeline owner consents to this processing on behalf of all viewers of that timeline. Contributors who access a Shield-enabled timeline consent to their images being watermarked by the act of accessing the content.

8. Sealed letters and time-locked content

Sealed letters are posts with a future unlock date set by the poster. No one, including FM2Y staff, can read the content of a sealed letter before its unlock date. The unlock is triggered automatically by our server when the unlock date arrives. The poster may edit or delete a sealed letter before its unlock date but not after.

FM2Y is not responsible for technical failures that delay the delivery of sealed letters, though we make commercially reasonable efforts to ensure timely delivery. Sealed letters that were posted before a billing lapse are grandfathered and will deliver on their unlock date for as long as the timeline's content remains stored (see Section 5.7).

9. Timeline handoffs and custodial transfers

FM2Y provides automated tools for transferring timeline ownership. We are not a fiduciary, trustee, or legal executor. Custodian designations and beneficiary assignments within FM2Y are instructions to our software systems and do not constitute legally binding trust instruments, wills, or power of attorney documents.

For matters of legal succession, estate planning, or the formal transfer of digital assets, you should consult a licensed attorney.

10. Intellectual property

FM2Y, its logo, design, code, and non-user-generated content are the property of Trimble Digital LLC, protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without written permission.

11. Disclaimers

FM2Y is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that data will never be lost.

We strongly recommend that you maintain personal backups of content you consider irreplaceable. FM2Y's export feature allows you to download a full copy of your timeline at any time.

12. Limitation of liability

To the maximum extent permitted by applicable law, FM2Y and its affiliates, officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, service interruption, or any other intangible losses, arising from:

  • Your use of or inability to use FM2Y;
  • Unauthorized access to or alteration of your data;
  • The conduct of any third party on or through FM2Y;
  • Any bugs, viruses, or other harmful code transmitted through FM2Y;
  • Errors or omissions in any content, or any loss or damage resulting from use of content.

In no event shall our total aggregate liability to you for any claim exceed the greater of (a) the amount you paid FM2Y in the 12 months before the claim, or (b) $100 USD.

13. Indemnification

You agree to indemnify, defend, and hold harmless FM2Y and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of FM2Y, your violation of these Terms, your violation of any third party's rights, or any content you upload to FM2Y.

14. Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if required by law. You may close your account at any time by contacting us at hi@shmo.me.

Upon termination, your right to use FM2Y ceases immediately. Sections 4.2 (contributor license), 6.1 (content license), 10 (IP), 11 (disclaimers), 12 (liability), 13 (indemnification), and 15 (governing law) survive termination.

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of FM2Y shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.

If you are a consumer in a jurisdiction with mandatory local consumer protection laws, those laws may give you rights that override this clause.

16. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before the change takes effect. Continued use of FM2Y after the effective date of updated Terms constitutes acceptance of those Terms.
